Italy’s new Highway Code: what changed in the fines

Italy’s new Highway Code is law 177 of 25 November 2024, in force since 14 December 2024. For the fines this site calculates it changed four main things. Holding a phone while driving went from €165–€660 to €250–€1,000, with 5 points and a 15-day to 2-month suspension from the first offence, so the 30% discount no longer applies; a repeat within two years costs €350–€1,400 and 10 points. Speeding by 10 to 40 km/h twice in a year in a built-up area now costs €220–€880 with a 15 to 30-day suspension, while several speeding offences recorded by the same body within an hour are fined as one plus a third, when that is cheaper. A new short suspension of 7 or 15 days applies to drivers stopped on the spot for certain offences who hold fewer than 20 points. Illegal parking is charged for each 24 hours, and a pay-and-display ticket that has only just run out costs less. The base amounts are the 2026 ones until the 2027 update decree.

What law 177 of 2024 is
Law 177 of 25 November 2024 is the 2024 reform of the Italian Highway Code (Codice della Strada), published in the official journal on 29 November and in force since 14 December 2024. It covers many subjects: drink and drugs, alcohol interlocks, new drivers, e-scooters, cyclists, parking, cameras. This page only takes the changes that alter the amounts, points or suspensions of the offences calculated here, as read in the text published on Normattiva, the official Italian law database, on 24 October 2026. The amounts shown are those in force in 2026.
Phones at the wheel: higher amounts and an immediate suspension
Article 4 of the law rewrites paragraph 3-bis of article 173. The table compares the previous text with the current one.
| Holding a phone while driving | Before 14-12-2024 | From 14-12-2024 |
|---|---|---|
| First offence | €165–€660, no suspension | €250–€1,000, 15-day to 2-month suspension |
| 30% discount within 5 days | €115.50 | no longer allowed |
| Further offence within two years | rule rewritten by the reform | €350–€1,400, 1 to 3-month suspension |
| Points (article 126-bis table) | line rewritten by the reform | 5, then 10 on a repeat |
The less obvious effect is on the discount: article 202 rules out the 30% reduction whenever an offence carries a licence suspension, and the suspension now applies from the first offence. The minimum due within 60 days is therefore €250. Details are on the phone fine page.

Speeding: repeat offences in towns and several offences in an hour
The bands of article 142 are unchanged, but the law added two rules. Paragraph 8 gained a second sentence: if a 10 to 40 km/h offence is committed in a built-up area at least twice in a year, the fine is €220 to €880 instead of €173–€694, with a licence suspension of 15 to 30 days. New paragraph 6-ter works the other way: several offences by the same vehicle recorded by the same body, on its roads and within an hour of the first, are punished with the penalty for the most serious one plus a third, if that is lower than the total. The law also states, in article 45, that devices with a measuring function, such as speed cameras, remain subject to periodic functional checks and calibration. The full calculation by band is on the speeding fine page.

The points-based short suspension
New article 218-ter brings in a suspension that depends not on how serious the offence is but on the points balance. It is added to the fine for a set list of offences, including running a red light (article 146, paragraph 3), not wearing a seat belt (article 172, paragraphs 10 and 11), using a phone (article 173, paragraph 3-bis), overtaking where it is banned and some motorway offences. It lasts 7 days if the licence holds fewer than 20 points but at least 10 when the offence is recorded, 15 days with fewer than 10, and doubles if the driver caused a crash. The police take the licence on the spot, without waiting for a decision by the prefetto (the government’s representative in the province). It only applies to drivers identified at the moment of the offence, never to a fine served by post. How to check a balance is explained on the licence points page.
Parking, pay-and-display bays and ZTL zones
Article 24 of the law deals with parking. Under article 7, paragraph 14, illegal parking that lasts more than 24 hours is fined for each 24-hour period, and overstaying a maximum parking time has its own amount, multiplied by the periods elapsed up to four times. For pay-and-display bays (the blue lines) where the ticket ran short, paragraph 15 sets a scale: no fine if the check happens within 10% of the time paid for, half the fine (€21.00 instead of €42) between 10 and 50%, the full fine beyond, always plus the unpaid fee. Article 158 now sets new amounts for parking in disabled bays (€330–€990 for cars) and on pavements and crossings (€87–€344), plus a new paragraph 5-bis for junctions, bus stops and reserved lanes (€165–€660). For entries into a ZTL (limited traffic zone) caught by cameras, article 198 now allows a single fine per calendar day in the same zone, which matters to visitors who drive in and out of a historic centre several times. Full amounts are on the parking fine page.
Late payment and 2027 amounts
Article 26 of the reform caps the surcharge for late payment under article 27 of law 689 of 1981: for Highway Code penalties it may not exceed three fifths of the penalty. The base amounts are frozen: the two-yearly update of article 195 was suspended up to 2026, and the decree for penalties applied from 1 January 2027 must be adopted by 1 December 2026. It has not been published yet, so no 2027 figure appears on this site. For the full list of offences with amounts and points, see the Italian traffic fines list.
